This report seeks approval for the adoption of the Building Height and Tall Buildings Supplementary Planning Document (SPD).
Borough Local Plan Policy QP3a commits the Council to preparing a Building Height and Tall Buildings SPD. The SPD provides that guidance and sets out in detail what the Council considers to be appropriate in terms of location, height, and design for tall building developments throughout the borough. The adoption of the SPD will help the Council to ensure that any proposed tall development that comes forward is appropriate and of the highest quality.
Once adopted, the SPD will be an important material consideration in the determination of planning applications.

13/12/2023 - Procurement of Stop Smoking Services ref: 188 For Determination
The contract for RBWM’s current Stop Smoking Service ends on 31March 2024. The RBWM Public Health went out to tender for a new Stop Smoking Service on Friday 15 September 2022 to appoint a new provider to deliver the Stop Smoking Service from the 1st April 2024, the total contract price was £480k (£120k per annum) for an initial 2-year period, with the option of a possible extension of 1+1 years.
On 4 October 2023 the government announced that it is investing an additional £70 million per year to support local authority-led stop smoking services. For RBWM, this will result in receiving an indicative £128k per annum between 2024/25 -2028/29. And so, the financial envelope of the RBWM Stop Smoking Service may be increased up to £248k per annum. Due to this announcement, it was also decided to increase the duration of the contract by a further year, meaning that the contract term will now be 2+1+1+1. The minimum contract value of the Stop Smoking services will now exceed £600k (excluding the indicative funding from the government), therefore meeting the relevant threshold to now be considered as a Key Decision.
Public Health are now seeking approval from Cabinet to approve delegated decision-making authority to be granted to the Executive Director of Adult Services and Health and the Cabinet Member for Adults Services, Health and Housing, to approve the outcome of the current Stop Smoking Procurement.

The Mill Lane Conservation Area is located in
Clewer Village to the north-west of Windsor. The area was
designated in 1974 but does not have a Conservation Area Appraisal.
A Conservation Area Appraisal is an important document for
development management purposes that explains the importance of a
conservation area and describes how this can be retained and
enhanced, particularly when new works are proposed. This report
seeks Cabinet approval for the draft Mill Lane Conservation Area
Appraisal and agreement to undertake a period of public
consultation on the document. The appraisal will then be revised to
take account of the views of local residents and interested
parties, and submitted to Cabinet for final approval.

Councillor Hill, Cabinet Member for Highways and Transport, Customer Service Centre & Employment, outlined the report and provided some background information on the car park history and its recent structural failings that were allowed to occur under the previous administration. He stated that the demolition would take roughly around 10 months, on top of the time needed for a procurement process to take place between approval and demolition commencement.
The Chair thanked Councillor Hill for his efforts in progressing the report that was before Cabinet, as it had been originally pencilled in for Autumn.
Councillor Coe asked for some clarity for the public as to how the process of the demolition would occur. Andrew Durrant, Executive Director of Place Services, said that the car park was located within a central part of the town, within close proximity to various different neighbours, so admitted that it of course would come with its challenges, however it was necessary. He also discussed about the new signage that was being planned to be installed, advertising the alternate Vicus Way car park.
Councillor Price asked if the car park was planned originally to be demolished regardless of these current situations. Andrew Durrant confirmed that in the future with the proposed redevelopment of the Nicholsons hopping centre, the plan was to do this at some point.
Councillor Davies said that it was a shame from a climate and sustainability viewpoint that the Council was in this position.
Councillor Hill said that he wished for the parking strategy item to come to Cabinet in the very near future. Andrew Durrant confirmed that his team would be moving it forward as fast as possible.
The Chair seconded the recommendation.

Councillor Jones outlined the report to Cabinet. She said that there was a historic low level of Council tax that the borough had to work with, which was big pressure for the Council. Reserves had strengthened over the last few years; however, this was still not enough as explained within the previous item. In 2024/25, forecast interest and borrowing was a rate of £10 million.
Andrew Vallance said that there would be a series of 1-year settlements provided. The details of next year’s settlements were purely assumptions at this time and would not be known until December 2023. This was coupled with there being a General Election in 2024, which could indeed change things once again. He did note that there would be no gap if it was not for rising inflation and interest rates. He then stated that when using last year’s levels, there would already be a balanced budget at this current moment in time.
Councillor Bermange wished to acknowledge the comments that had been made by Andrew Vallance and asked him if the realities of service demand were being correctly acknowledged in forward planning areas. Kevin McDaniel, Executive Director of Adult Services & Health offered some clarity to this.
Councillor Jones summarised the position of the Council that had been discussed and asked Cabinet to note the report and the recommendation set out.

Cabinet considered the report titled ‘Disposal of Open Space Land, Land at Braywick Park, Maidenhead’.
The Cabinet were addressed by 2 public speakers, Andrew Hill and Stephen Bough, both who were attending virtually. Due to technical difficulties, Stephen Bough was unable to fully deliver his speech. Oran Norris-Browne, Principal Democratic Services Officer, invited Stephen to email him his speech, to read out on his behalf to the Cabinet Members. Andrew Hill then addressed the Cabinet for 3 minutes.
Councillor Reynolds, Cabinet Member for Communities and Leisure then introduced the report to Cabinet Members by outlining the report and giving a brief history of the process since it began in 2019. 22 objections had been received to the item, which led to a statutory requirement for the Cabinet to consider these when deciding on a recommendation. He added that it was a difficult decision for Cabinet to make as there were many positives, however the objections that had been received were also very valid and needed to be taken into account.
Oran Norris-Browne, then proceeded to read out the remaining segments of Stephen Bough’s comments on his behalf due to the technical difficulties that had been experienced, upon request of the Chair.
Councillor Taylor then indicated her desire to speak virtually as a non-Cabinet Member, which the Chair allowed. As Ward Councillor she said that the area was very well used by the public, schools, youth groups and many more. She stated that the current buildings were present at the site, however they were not grouped together and therefore did not spoil the openness of the green open space. She then outlined the areas that would be lost if the open space was disposed of. Further objections had been made at consultations and that the 22 that were listed within the report, were not the only ones. She paid tribute to Maidenhead Football Club, but stated that once the open space was lost, it was an irreversible decision.
Councillor Davies, Cabinet Member for Climate Change, Biodiversity and Windsor Town Council, said that she was concerned about the large loss of open space to Maidenhead. Open green space was very important for general wellbeing, which was directly mentioned within several of the 22 objections that were received on this item.
Councillor Del Campo, Cabinet Member forAdults, Health & Housing Services, said that the annual cost was concerning as it was less than for a flat within the town centre.
Councillor Coe, Cabinet Member for Environmental Services, said that he had taken on board all of the information that officers had provided within the report and also the objections that had been received from residents. He was concerned about the open space loss of this land, especially if the proposed development went forward on the golf course too. He felt that the value to residents was diminished if this decision went through.
Councillor Jones, Deputy Leader of the Council and Cabinet Member for Finance, wished to make a point of clarification to the Cabinet that borrowing costs would be brought down. The cost-of-living crisis was very prominent and that taking away a free public open space would be a concern.
The Chair said that he acknowledged the hard work of Maidenhead Football Club and their work in the community, however this needed to be balanced finely with the loss of open space to Maidenhead and that it was currently at a premium within the area, especially with the increase in population in recent times.
Councillor Reynolds acknowledged and welcomed the debate amongst speakers on this item. He said that it appeared that fellow Cabinet Members shared similar views on the loss of the open space to the town.
Councillor Reynolds proposed that Cabinet did not agree to the disposal of the open space. This was seconded by Councillor K. Davies.
A show of hands occurred from Cabinet Members who were in support of this.
AGREED UNANIMOSULY: That Cabinet considered the objections received in relation to the proposed disposal (by the grant of a lease) of land at Braywick Park, Maidenhead (“the Open Space”) following the statutory notification of the Council’s intention to dispose of the Open Space and having regard to the objections, confirmed that they did not agree to the disposal of the Open Space.

Councillor Carroll, Cabinet Member for Children’s Services, Education, Health, Mental Health, & Transformation introduced the report by stating that the government provided funding to the borough to maintain and improve school buildings and grounds. This funding was for voluntary and community-controlled schools only. Cabinet was being asked to approve the projects that were set out within the report over the period 2023-24. This included various endeavours from gutters to radiators and therefore was quite an undertaking in terms of infrastructure.
Lin Ferguson, Executive Director of Children’s Services & Education said that the overall budget was already in the borough's capital programme, but the individual scheme's budgets were shown in appendix D (part 11).The round of schemes would still leave some capital to be allocated this year following the completion of relevant surveys. The recommendation was that the decision for these new projects was delegated to the DCS and Procurement Manager so that they could procure and enter into contracts.
This was proposed by Councillor Carroll and seconded by Councillor Johnson.
RESOLVED UNANIMOUSLY: That Cabinet noted the report and:
i) Approved the capital schemes, and their budgets as set out in the appendices for inclusion in the 2023/24 capital programme.
ii) Delegated approval of a second round of prioritised projects for inclusion in the 2023/24 capital programme to the Director of Children’s Services.
iii) Delegated authority to the Director of Children’s Services and the Procurement Manager to undertake procurement and enter into contracts for the delivery of the schemes set out in the appendices, including where varied under recommendation (ii).

Councillor McWilliams, Cabinet Member for Digital Connectivity, Housing Opportunity, & Sport & Leisure introduced the report by saying that £796,000 of additional expenditure was being sought in order to complete the expansion of John West House. This scheme had been in the capital programme for the last year, and it would deliver an additional 16 bedrooms within the property. He then went on to describe the facilities that were on offer at the location and described the impacts of the pandemic that had been seen on the location. The additional bedrooms would be available for the residents that were on the rough sleeper’s pathway.
Councillor Hilton, Cabinet Member for Asset Management & Commercialisation, Finance, & Ascot, asked if the location provided adequate space to accommodate all who were sleeping rough within the borough. The Cabinet Member for Digital Connectivity, Housing Opportunity, & Sport & Leisure replied by saying that there were various stages of the pathway. Once residents entered at stage 3, they would live in semi-independent living quarters whilst receiving funding from officers with a view to eventually becoming fully independent.
Tracy Hendren, Head of Housing, Environmental Health & Trading Standards added to this by saying that John West House would be used at stage 1 for the assessment stage and also stage 2 where intense support would be provided for up to 2 years in John West House. John West House would be a learning house with independent self-contained accommodation, to allow residents to sustain a tenancy in the future. They would then move on to stage 3 independent accommodation with floating support for up to 6 months to ensure that they could sustain a tenancy moving forward.
The Cabinet Member for Digital Connectivity, Housing Opportunity, & Sport & Leisure said that 4 years ago there was no rough sleeper pathway and that none of the progress on show would have been possible without the hard work of officers and he wanted to place on record his thanks to Tracy Hendren and her team.
The Chair echoed these comments and said that the administration had left the borough in a better place than when they took over 4 years ago, despite the rising inflation levels seen in recent times.
This was proposed by Councillor McWilliams and seconded by Councillor Coppinger.
RESOLVED UNANIMOUSLY: That Cabinet noted the report and:

Councillor Coppinger, Cabinet Member for Adult Social Care & Maidenhead introduced the report by saying that this paper would affect all residents, as at some point in everyone’s life, residents would be in need of care either at an external location or within their own home. He said that the current system was at increased risk of security breaches and that the borough needed a new system that was capable of providing strength-based practices, in order for residents to be able to stay as independent as possible for as long as possible. He asked Cabinet to approve the expenditure of £910,381 for the supply, implementation, and maintenance of the chosen Case Management System. He said that this sum of money had already been approved within the budget process at Full Council.
Councillor Haseler, Cabinet Member for Planning, Parking, Highways & Transport, wholeheartedly agreed with this. He said that the current system was at the end of its current life, and that he wished to second the proposal to see a new and more efficient system come into effect, which would have a positive impact on all residents.
This was proposed by Councillor Coppinger and seconded by Councillor Haseler.

The Sub-Committee carefully considered all the submissions. The Sub-Committee expressed the licensing objectives were not being met and there was public nuisance, based on the comments and observations of Mr and Mrs Hamilton’s and the resultant evidence given by the Thames Valley Police, the Environmental Protection Officers and Licensing. They were particularly reliant on the statements given by the Community Safety Wardens Ben Higgs and Jake Hynard, as the behaviour of Mr Candido Rodrigues raised concerns to the safety of the public. The evidence given by Elizabeth Johnson, Environmental Protection Officer evidence also showed breaches of the Noise Abatement Notice on 27th October and 16th November 2019.
After careful consideration of all the evidence, the Sub-Committee decided that the following conditions be added to the premises licence for Pazzia Restaurant:
1. No person shall be permitted in the outdoor seating at the front of the premises between 22:00 hours and 7:00 hours.
2. The smoking solution will be moved to the left hand side (facing towards the premises) at 22.00 hours, 7 nights per week.
3. No table or chairs to be provided at the side and rear of the building.
4. Digital CCTV monitoring system must be installed at the front, side and rear of the building and maintained to Thames Valley Police standard. Recordings to be kept securely for 31 days and made avgailable to Thames Valley Police employees and Authorised Persons as defined by Section 13 & 69 Licensing Act 2003 upon request.
a. DPS or nominated person to be trained on how to work the CCTV system to the standard where the nominated person can download any potential evidence required by Thames Valley Police employees and Authorised Persons as defined by Section 13 & 69 Licensing Act 2003.
b. Nominated person is responsible in supplying the necessary media (discs, data sticks) containing any downloaded content. Refusals Register to be on the premises and kept up to date and made available upon the request of the Police, Trading Standards and Authorised Persons as defined by Section 13 & 69 Licensing Act 2003.
5. Outdoor entertainment and singing is not permitted at any time.
6. There shall be no live or recorded music after 23:00 hours, seven nights a week.
