RIGHTS OF WAY & HIGHWAY LICENSING PANEL

13 FEBRUARY 2008

PRESENT: Councillors Stretton (Chairman), J Evans (substituting for Councillor Walters) Hendry, Mrs Hunt, Mackay, McBride, Richards (substituting for Councillor Werner) and Mrs Wilson.

Also Present: Councillor Wiles.

12/07 APOLOGIES FOR ABSENCE

Apologies for absence were received from Councillors Beer, Walters and Werner.

13/07 MINUTES

RESOLVED: That the minutes of the meeting of the Panel held on 10 September 2007 be taken as read and confirmed.

14/07 DECLARATIONS OF INTEREST

There were no declarations of interest.

15/07 LICENCE APPLICATION FOR STREET CAFÉ – NORAH’S ANTIQUES AND OLD TEA ROOMS, 51 THAMES STREET, WINDSOR
    (The Panel was addressed by Parish Councillor Cadwallader, representing Eton Town Council)

Members considered an application by Norah’s Antiques and Old Tea Rooms in respect of their premises at 51 Thames Street, Windsor, and the objections to the application which had been received.

The representative of Eton Town Council, the Head of Highways, the Licensing and Enforcement Officer, and non-members of the Panel were asked to withdraw from the meeting during the Panel’s deliberation and determination of the application. At the conclusion of the deliberation they were invited back into the room to hear the Panel’s decision.
        RESOLVED: That authority to determine the application submitted by Norah’s Antiques and Old Tea Rooms for a Street Café Licence outside 51 Thames Street, Windsor be delegated for approval by officers (including the Conservation Officer), in consultation with the Chairman of the Panel, subject to the following conditions being negotiated with the applicant:

Ø That three large or four small tables be permitted, with a maximum of twelve chairs.
Ø A minimum two metre gap be maintained at all times between the premises and the tables and chairs, to allow free passage of pedestrians.
Ø That the licensed area be appropriately marked by a suitable barrier, for the safety of customers and other users of Thames Street.
Ø That the license be permitted for a period of two years.

        With authority to refuse the application if the above conditions cannot be negotiated.

16/07 LICENCE APPLICATION FOR STREET CAFÉ – PAPA G’S, 48 THAMES STREET, WINDSOR
    (The Panel was addressed by Parish Councillor Cadwallader, representing Eton Town Council, and by Mr Johal, on behalf of the applicant)

Members considered an application by Papa G’s in respect of their premises at 48 Thames Street, Windsor, and the objections to the application which had been received.

The representative of Eton Town Council, the representative of Papa G’s, the Head of Highways, the Licensing and Enforcement Officer, and non-members of the Panel were asked to withdraw from the meeting during the Panel’s deliberation and determination of the application. At the conclusion of the deliberation they were invited back into the room to hear the Panel’s decision.
        RESOLVED: That authority to determine the application submitted by Papa G’s for a Street Café Licence outside 48 Thames Street, Windsor be delegated for approval by officers (including the Conservation Officer), in consultation with the Chairman of the Panel, subject to the following conditions being negotiated with the applicant:
Ø That four tables and twelve chairs be permitted, or fewer tables and chairs be permitted if space is found to be limited.
Ø That no part of the licensed activity should take place on the footway adjacent to Datchet road, for reasons of safety.
Ø A minimum two metre gap be maintained at all times between the premises and the tables and chairs, to allow free passage of pedestrians.
Ø That the licensed area be appropriately marked by a suitable barrier, for the safety of customers and other users of Thames Street.
Ø That the license be permitted for a period of two years.

        With authority to refuse the application if the above conditions cannot be negotiated.
