Cllr Hilton – Declared a personal interest in item 16/03629 as a member of Sunninghill and Ascot Parish Council, which previously considered the application.

 

Cllr Lenton – Stated that after being given advice he would be declaring a prejudicial interest in item 16/03275 because he had made comments that could be deemed to be of a prejudicial nature in his call-in on the item, and because his wife had registered to speak in opposition to the application. He stated that he was a member of Wraysbury Parish Council but had not been present at the meeting when the application had been discussed. He stated that he would not take part in the discussions or the vote on the item.

 

Cllr Lenton stated his belief that he had been asked to declare a prejudicial interest due to a new interpretation of the rules regarding declaring interests. The Head of Law and Governance said the wording of Cllr Lenton’s call-in, and the fact that his wife was speaking in opposition to the application, could lead to an accusation of bias and a pre-determination of the application in the eyes of a reasonable bystander. As a result of the discussions following Cllr Lenton’s declaration, and the explanation for it, Cllr Rayner requested further legal guidance relating to member declarations. Cllr Rayner also stated that in regard to item 16/03275 he had received numerous emails from residents in relation to the application, but had not expressed an opinion on the application in any correspondence.

 

Cllr Dr Evans – Declared a personal interest in item 16/02052 as a member of Sunningdale Parish Council. She stated that she had been present at the meeting when the application had been discussed but had not taken part in the vote and had offered no opinion on the application.

                        (The Panel was addressed by Michael Burn of Sunningdale Parish Council in opposition to the application and by Martin Ashley, the agent, in support.)

 

16/03275*        FPC (Wraybury) Ltd: Change of use from car sales showroom and repair and servicing workshop (sui generis/B2) to shop (A1), including extension and alterations together with associated access, parking and refuse storage, following demolition of one of the existing buildings and canopy at Concord Garage, 31 Windsor Road, Wraysbury, Staines TW19 5DE – THE PANEL VOTED UNANIMOUSLY to DEFER the application in order for Members to attend a site visit and for the levels of the buildings to be confirmed.

 

                        (The Panel was addressed by Henry Perez, Graham Cribbin and Margaret Lenton in opposition to the application, Andrew Moran of Wraysbury Parish Council in opposition, and by Jeremy Heppell, the agent, in support of the application.)

 

16/03629*        Mr Barter – Millgate: Construction of 4 x two bed apartments with access, parking and landscaping following demolition of existing 2 x ancillary outbuildings at The White House and Wee Flat, Englemere Estate, Kings Ride, Ascot – THE PANEL VOTED UNANIMOUSLY to authorise the Head of Planning to APPROVE the application subject to the securing of the necessary mitigation and payments towards SAMM and SANG, in line with the Officer’s recommendation.

Minutes:

The contents of the report were noted by the Panel. Cllr Beer remarked that the Planning Appeals referenced 16/60099/NOND and 16/60100/NOND in the Appeal Decision Report related to applications in the Windsor Urban area and the report should be sent to the relevant Development Management Panel for noting.
